This data protection statement provides you with information what personal data Ticketcorner AG («Ticketcorner», «we», «us») collects from you and how and for what purposes it processes them. It applies to all personal data collected upon visiting the websites ticketcorner.ch, fansale.ch, ski.ticketcorner.ch, skip.ch, mindfulapp.io, as well as the partner websites provided by Ticketcorner, including the chat and mobile applications offered (hereinafter collectively referred to as «Websites»).

We use personal information for the purpose of maintaining functional Websites and providing our contents and services. Ticketcorner treats personal information with confidence, care and for the given purpose. In doing so, we adhere to the relevant requirements of the applicable data protection legislation.

  • 3.1 Access data when you visit our Websites
  • When you visit our Websites, the browser used on your computer or mobile device automatically sends information to the server of our Websites. This information is temporarily stored in a so-called log file. The following information will be collected without your assistance and stored until erasure:

    • name and URL of the retrieved file
    • date and time of retrieval
    • transferred amount of data
    • message about successful retrieval (HTTP response code)
    • browser type and version
    • operating system
    • referrer URL (i.e. the previously visited website)
    • websites accessed by the user’s system through our website
    • Internet service provider of the user
    • IP address and the requesting provider

    We use this log data without assigning them to you or to other statistical profiling and for the purposes of operation, security and optimisation of our Websites, but also for the anonymous recording of the number of visitors to our Websites (traffic) and the extent and nature of use of our Websites and services, as well as for billing purposes by measuring the number of clicks received from our partners. Based on this information, we can provide personalised and location-based content, analyse traffic, troubleshoot and improve our services.

    This is also our legitimate interest in the use of these data.

    We reserve the right to retrospectively review the log data if, on the basis of objective evidence, there is a legitimate suspicion of unlawful use. We store IP addresses in the log files for a limited period of time if necessary for security purposes, for the provision of services or the billing of a service, e.g. if you use one of our offers. In addition, as part of your account, we store the date of your last visit (e.g. when registering, logging in, clicking links etc.).

  • 3.2 Data necessary to fulfil our contractual obligations
  • We process personal data that we need to fulfil our contractual obligations to you, such as first name, surname, address, delivery address, e-mail address, billing and payment data.

    To make it easier for you to buy tickets in the future, we save your preferred payment method in your customer account. In addition, we transmit your personal data to banks, payment service providers, financial service providers and credit card companies, depending upon your selected payment method and process, for the processing of the payment and a possible refund of the purchase price.

    The erasure of these data takes place after expiry of the statutory storage periods. Any data associated with a customer account (see below) will be stored as long as this account exists.
    We may also use your personal information to verify compliance with sales requirements and, thus, to fight fraud.
    The legal basis for the processing of these data is the contract with you or our legitimate interest in the fight against fraud.

  • 3.3 Customer account/Live Club membership
  • To set up a customer account and registration as a member of the Ticketcorner Live Club, we need some of your contact details from you such as first name, surname, address, e-mail address and telephone number. With new registrations, we collect master data (name, address), contact data (e-mail address) as well as access data (user name and password).
    You can have your customer account or erased at any time using the contact details referred to in point 1, without incurring any costs other than the transmission costs according to the basic rates. The termination of your Ticketcorner Live Club membership is subject to the Ticketcorner Live Club Member Terms and Conditions.
    After erasing your customer account or terminating your membership in the Ticketcorner Live Club, we will then erase your personal data stored, as far as we do not have to store them for the execution of orders or due to legal retention obligations. The legal basis for processing these data is your consent.

  • 3.4 Newsletter and Ticket Alarm
  • To subscribe to our newsletter and ticket alarm, you will need the data requested in the registration process, in particular your e-mail address. Newsletter and ticket alarm registrations are logged. After registration, you will receive a message to your e-mail address asking you to confirm the subscription («double opt-in»). This is necessary so that third parties cannot register with your e-mail address.
    You can cancel your newsletter or ticket alarm subscriptions at any time using the contact details referred to in point 1 or revoke your consent to receiving a newsletter or ticket alarm at any time and thus unsubscribe from the newsletter without incurring any costs other than the transmission costs according to the basic rates. You will also find an unsubscribe link in every newsletter.
    We store the registration details as long as they are needed for the sending of the ticket alarm or newsletters. The registration logging and the e-mail address are stored as long as there is an interest in having the proof of the originally given consent.
    The legal basis for sending the newsletter is your consent. The legal basis for logging the registration is our legitimate interest in proving that newsletter is being sent with your consent.

  • 3.5 Information about the same or similar events or services
  • Regardless of whether or not you have subscribed to our newsletter, Ticketcorner may use the personal data collected in connection with a ticket purchase or cancelled ticket purchase to inform you about the same or similar events, services or partner offers in the future. You can unsubscribe from receiving such information at any time via the unsubscribe link in the relevant e-mails.

  • 3.6 E-mail and other contacts (FanReports, customer service)
  • If you contact us (e.g. via contact form or e-mail), we will process your details in order to handle the request, notification as well as follow-up questions.
    If data processing is carried out for the purpose of pre-contractual measures upon your request or, if you are already our customer, for the execution of the contract, the legal basis for this data processing is the fulfilment of the contract.
    We only process personal data if you consent to it or if we have a legitimate interest in processing your data. A legitimate interest might lie in responding to your emails or other requests.

  • 3.7 Participation in sweepstakes
  • If you participate in a sweepstake organised by us, we will process your data in order to conduct the competition and send notification of a prize (via e-mail or social networks).
    The legal basis for processing your data is your consent to participate in the competition.

  • 3.8 Contact tracing with Mindful
    • 3.8.1 Contact tracing and reservations

      You can use the Mindful Check-In App mobile application to enter personal data – and, where appropriate, data concerning other people that you are visiting a Business (event venue, mountain railway, catering business, leisure facility, etc.) with – so that these data can be transmitted to the Business in question, and by the latter to the health authorities, at a later date in order to track chains of infection in connection with COVID-19 («Contact Tracing»). The data will only be transmitted to the Business if the health authorities make an enquiry due to an infection that coincides with the time of your visit.

      In the context of Contact Tracing, we only process the pieces of personal data you provided that allow us to trace chains of infection in connection with COVID-19 («Contact Tracing Data»). In this regard, the Businesses apply different requirements, over which we have no control, on the basis of the statutory provisions put in place by the Confederation and the individual cantons. In general, the following pieces of Contact Tracing Data can be entered for individual visitors:

      • Surname and first name
      • E-mail address
      • Street and house number, postcode
      • Mobile telephone number (verified)
      • Information on the Business (location)
      • Date and time of check-in and check-out
      • Seat No./block/row (optional)
      • Device token (ID for the push notification system for iOS and Android devices)
      • Variable fields for additional data (depending on the Business)
      • Health questions (optional)

      If you enter Contact Tracing Data concerning other visitors, please make sure that you have provided these visitors with sufficient information about the processing of their data and that you are authorised to enter the data.
      You can also use the Mindful Check-In App to make reservations. Within this context, we only process the personal data you provided to make reservations and for waiting lists (reservation data):

      • Surname and first name
      • E-mail address
      • Street and house number, postcode
      • Mobile telephone number (verified)
      • Information on the Business (location)
      • Date and time of check-in and check-out
      • Seat No./block/row (optional)
      • Time and duration
      • Variable fields for additional data (depending on the Business)

      As the contract data processor, we process the personal data for Contact Tracing and reservations on behalf of the Business to which you make these data available. We explicitly remind you that Ticketcorner assumes no responsibility whatsoever for the collection and processing of Contact Tracing Data and reservation data by the Business that you or other individuals wish to visit; this also applies to any forwarding of Contact Tracing Data to health authorities. In such cases, the Business to which you make these data available has sole responsibility for data processing; in this regard, please refer to the data protection information provided by the Business.

      Your Contact Tracing Data and your reservation data will be transmitted to our servers in encrypted form. If a risk event occurs, the key to your Contact Tracing Data on the server will only be made available to the Business on request to allow the latter to pass your data on to the health authorities.

      The Business is obliged to erase the Contact Tracing Data once a statutory period defined by the Federal Council (COVID-19 Ordinance) has elapsed. At the time this data protection statement is published, the statutory retention period is 14 days after the Business was visited. Once this statutory retention period has elapsed, the Contact Tracing Data will be erased automatically, together with the reservation data.

    • 3.8.2 Registration for the Mindful Check-In App

      You need to register in order to be able to use the Mindful Check-In App. Only the personal data that we need to make our app available and to perform and process our services, or the personal data you have provided us with voluntarily, will be collected and processed. These registration data include:

      • Surname and first name
      • E-mail address
      • Street, house number and postcode
      • Date of birth
      • Mobile telephone number (verified by SMS code)

      The registration data will only be saved locally on your device; this means that we cannot access them. You can opt to erase these data at any time.

    • 3.8.3 Registration of employees of the Business

      Registration data concerning the Business’ employees is processed for the purposes of using the Mindful Enterprise App mobile application. These registration data include:

      • Employee’s surname and first name
      • Employee’s e-mail address
      • Location

    • 3.8.4 Push notifications

      We use push notifications in order to send you messages regarding reservations and check-outs in the Mindful apps.

      In order to allow push notifications to be sent, a Firebase Cloud Messaging registration token is created when you first launch the app, allowing the app installation to be uniquely identified on your device. This token allows the notification destination to be identified.

      The notifications are sent using the Google Firebase Cloud Messaging service offered by Google, Inc. Mountain View, USA.     • 3.8.5 Cookies

      No cookies are saved on your end device when you use the Mindful mobile applications and the mindfulapp.io website.

    • 3.8.6 Web analysis services

      No web analysis services are used when you use the Mindful mobile applications and the mindfulapp.io website.

    • 3.8.7 Google Tag Manager

      Our website mindfulapp.io uses the Google Tag Manager. The Tag Manager allows tracking tools and website tags to be managed. This service does not use cookies and no personal data are collected. The Google Tag Manager does not collect any personal data itself. The Google Tag Manager makes it easier for us to implement and manage our tags.

    • 3.8.8 Google Fonts

      Our website mindfulapp.io uses web fonts made available by Google LLC to ensure that fonts are displayed uniformly. When you open a page, your browser loads the required web fonts into your browser cache to display text and fonts correctly. If your browser does not support web fonts, your computer uses a standard font. Accessing script libraries or font libraries automatically triggers a connection to the library operator. In theory, it is possible for the operators of these libraries to collected data – although it is currently unclear whether they actually can and for what purposes.

  • 3.9 Contact tracing with TICKETCORNER.CheckIn
    • 3.9.1 Contact Tracing

      You can use the TICKETCORNER.CheckIn mobile and web applications to enter personal data – and, where appropriate, data concerning other people that you are attending an event with – so that these data can be transmitted to the event organiser in question, and by the latter to the health authorities, at a later date when you enter an event venue and at your instigation in order to track chains of infection in connection with COVID-19 («Contact Tracing»). The data will only be transmitted to the event organiser if the health authorities make an enquiry due to an infection that coincides with the time of your visit.

      In the context of Contact Tracing, we only process the pieces of personal data you provided that allow us to trace chains of infection in connection with COVID-19 («Contact Tracing Data»). In this regard, the Businesses/event organisers apply different requirements, over which we have no control, on the basis of the statutory provisions put in place by the Confederation and the individual cantons. In general, the following pieces of Contact Tracing Data can be entered for individual event visitors:

      If you enter Contact Tracing Data concerning other visitors, please make sure that you have provided these visitors with sufficient information about the processing of their data and that you are authorised to enter the data.

      As the contract data processor, we process the personal data for Contact Tracing on behalf of the event organiser to which you make these data available. We explicitly remind you that Ticketcorner assumes no responsibility whatsoever for the collection and processing of Contact Tracing Data by the event organiser for events that you or other individuals wish to visit; this also applies to any forwarding of Contact Tracing Data to health authorities. In such cases, the event organiser to which you make these data available has sole responsibility for data processing; in this regard, please refer to the data protection information provided by the event organiser.

    • 3.9.2 Processing for IT security purposes

      When you use TICKETCORNER.CheckIn, we process the personal data that we require for technical purposes in order to make TICKETCORNER.CheckIn available and ensure stability and security when you use TICKETCORNER.CheckIn. We process the following personal data for this purpose:

      • UUID
      • IP address

      We process personal data based on our legitimate interest in making TICKETCORNER.CheckIn available to you and ensuring IT security for you when you use TICKETCORNER.CheckIn.

    • 3.9.3 Cookies

      No cookies are saved on your end device when you use TICKETCORNER.CheckIn.

    • 3.9.4 Retention and erasure of personal data

      If you enter personal data in the TICKETCORNER.CheckIn mobile application, these data will only be saved locally on your device to begin with; this means that we cannot access them. You can opt to erase these data at any time.

      If you transmit personal data in electronic form in TICKETCORNER.CheckIn at your own instigation to allow infection chains in connection with COVID-19 to be tracked, e.g. when you enter an event venue, these data will be saved on our servers for a certain period of time. The data are saved on behalf of the event organiser or operator of the event venue concerned; Ticketcorner Ltd acts as the contract data processor in this regard. The event organiser or operator of the event venue is obliged to erase the data once a statutory period defined by the Federal Council (COVID-19 Ordinance) has elapsed; Ticketcorner Ltd assumes no responsibility in this regard. For more details, please refer to the data protection information provided by the event organiser or operator of the event venue concerned.

  • 3.10 Affiliate programmes and affiliate links
  • Our website features an embedded hotel card from the third-party provider Stay22. If you follow the links on this hotel card (affiliate links) and go on to make use of the offers provided via those links, we may receive remuneration from the third-party provider in the form of commission.

    The third-party provider (Stay22) has to know you have followed embedded affiliate links in our website in order to ascertain whether you have made use of the offers in the hotel card. Affiliate links are assigned to relevant transactions or other activity (e.g. purchases) solely in order to calculate any commission due. These assignments are removed when they are no longer required for this purpose.

    For the purposes of assigning affiliate links as described above, certain values can be added to the links. These values can be added as integral parts of the links concerned, or saved separately (e.g. in a cookie). Specifically, these additional values may include the website from which the link was accessed (the referrer), the time at which it was accessed, an online identifier for the operator of the website where the affiliate link was located, an online identifier for the offer concerned, the type of link used, the type of offer, and an online identifier for the user.     Your data will be processed on the basis of our legitimate interest (specifically our interest in being able to provide efficient, profitable, user-friendly services, and our interest in determining the amount of affiliate remuneration due).

Ticketcorner uses the so-called cookies in order to simplify the use of the services and to obtain information for the purpose of improving the services.
In particular, we use the so-called session cookies to optimise our Websites. A session cookie is a small text file that is sent by the respective servers when visiting a website and stored on your hard disk. This file contains a so-called session ID, with which various requests from your browser can be assigned to one session. These cookies will be deleted after you close your browser. Among other things, they allow you to use the shopping cart feature across several pages.
We also use a small amount of persistent cookies (also small text files stored on your device) that remain on your device and allow us to recognise your browser the next time you visit our Websites. These cookies are stored on your hard drive and deleted after a given time. Their lifespan is 1 month to 10 years. They enable us to present our offer in a more user-friendly, effective and secure way, and to show you, for example, information tailored to your interests.
Finally, our website uses interest-based advertising facilitated through advertising cookies, including retargeting / remarketing technologies of the third party Admeira AG, Bern, www.admeira.ch. Based on the interest in our products and services that you indicated by visiting our website, these enable us to show you customized advertising content on third-party websites.
Our legitimate interest for the use of cookies is to make our websites more user-friendly, efficient and secure and to optimally adapt the available information to your interests and make your on-line experience as informative as possible.

Once the cookie is activated, it will be given an identification number and your personal data will not be assigned to this identification number. Our Websites use social plugins (hereinafter «plugins») of various social networks, such as Facebook and Twitter (hereafter «networks»), to promote our company. The underlying commercial purpose is to be regarded as a legitimate interest. The respective providers guarantee compliance with data protection rules.
The integration of these plugins is done by means of the so-called double click method to best protect visitors of our Websites. The plugins are marked with a logo or a text hint. When you visit a page of our Websites that contains such a plugin, your browser establishes a direct connection to the network servers. The content of the plugin is transmitted by the networks directly to your browser and integrated into the website. By integrating the plugins, the networks receive the information that you accessed the corresponding page of our Websites. If you are logged in to one of the networks, the networks might associate your visit with your account. The purpose and scope of the data collection and the further processing and use of the data by the networks, as well as your rights in this regard and setting options for the protection of your privacy can be found in the privacy policies of the respective networks. If you do not want the networks to collect information about you through our Websites, you must log out of the networks before visiting our Websites. Even if you are not logged in to a network, sites with active network elements send data to the networks. We use different software solutions to optimise our online offer. By means of these solutions, the use of our Websites can be evaluated and valuable information about the needs of the users can be collected in order to continuously increase the user-friendliness of the online service and its quality. In order to carry out these analyses, aggregated and anonymous statistical data are collected. In the course of collection and processing, the visitor's shortened IP address is also considered.
The data are evaluated in particular for the following purposes:

  • measuring the areas of a website that are particularly attractive for the respective visitor;
  • evaluation of the visitor’s origin in order to optimise the offer;
  • modulation of recommendations according to target groups.

This procedure uses so-called permanent cookies (see also point 4 above). The user can reject to use these cookies at any time by appropriately setting their browser or only allowing storage after explicit confirmation. In addition, the user always has the option to completely block the use of data in all deployed solutions by choosing the so-called «opt-out option». For opt-out, however, no specific recommendations can be made.

The IP address provided by Google Analytics from your Internet browser will not be merged with other Google data. Ticketcorner also added the «anonymizeIP» code to Google Analytics on its Websites. This ensures the masking of the user’s IP address so that all data is collected anonymously. Only in exceptional cases will the full IP address be transferred to a Google server in the US and truncated there.
On the behalf of Ticketcorner, Google will use this information to evaluate the use of the website, to compile reports on website activity, and to provide other services related to the use of the website and the Internet with respect to the website operator. The user can prevent the storage of cookies by a corresponding setting of their browser; in this case, not all functions of the respective website may be fully used.
In addition, the user can prevent Google from tracking the data generated by the cookie and related to the use of the website (including the IP address), as well as the processing of these data by Google, by downloading and installing the browser plug-in: http://tools.google.com/dlpage/gaoptout?hl=en. As an alternative to the browser add-on, especially for browsers on mobile devices, the user can prevent the collection by Google Analytics by clicking on this link. An opt-out cookie will be set. Ticketcorner also uses Google Analytics to analyse data from double click cookies and AdWords for statistical purposes. If the user does not wish this, this can be disabled via the ads preferences manager ( https://www.google.de/settings/ads/).

Ticketcorner uses Google Analytics including the features of Universal Analytics. Universal Analytics allows us to analyse the activity on our Websites across devices (e.g. when accessed via a laptop and later via a tablet). This is made possible by pseudonymously assigning a user ID to a user. Such assignment takes place, for example, when the user registers for a customer account or logs on to this account. However, no personal data are being forwarded to Google. Although Universal Analytics adds additional functionalities to Google Analytics, it does not entail any restriction of data protection measures such as IP masking or the browser add-on.
This website also uses Optinmonster software supplied by Retyp LLC, 3701 Savoy Ln, West Palm Beach, FL 33417, USA. This allows us to provide our users with additional offers by overlays on our website. Personal data is only collected if the customer actively opts in (e.g. if the customer registers for the newsletter via a pop-up). OptinMonster does not save the collected data on its own servers; instead, it forwards it directly to Ticketcorner tools. Ticketcorner uses the Frosmo platform, which collects information about website visitors, to target them with content tailored to their needs and interests. In order to collect data, Frosmo uses various technologies, including browser cookies. By default, the Frosmo platform does not collect any personally identifiable information that would allow an individual to be identified. Frosmo never collects visitor data for its own purposes or for sale to third parties.

You have the following rights regarding your personal data. If you wish to assert these rights, please send your request by e-mail or by mail with a clear identification of your person to the address specified in section 1.

  • Request information about your personal data processed by us. In particular, you can provide information on the processing purposes, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned retention period, the right to rectification, deletion, limitation of processing or opposition, the existence of a right to appeal, the source of their data, if not collected from us, as well as the existence of automated decision-making including profiling and, where appropriate, meaningful information about their details;
  • Demand the completion or rectification of incorrect personal data stored by us immediately;
  • Demand the erasure of your personal data stored by us except where the processing is required for the exercise of the right of freedom of expression and information, for the fulfilment of a legal obligation, for reasons of public interest or for the assertion, exercise or defence of legal claims;

If you make a booking via a website of one of our partners (such as Migros Genossenschaftsbund) for which Ticketcorner operates a website, your personal data will also be transmitted to the respective partner.
If you make a booking on an electronic transfer medium (such as the SBB SwissPass), Ticketcorner is in addition entitled to forward your order data to the issuer of this transfer medium in so far as the issuer needs such data solely to fulfil its customer service obligations.

The personal data collected in connection with a ticket purchase can be used to inform you about the same or similar events in the future. You have the option to unsubscribe from receiving such information at any time.
If and to the extent that we outsource certain parts of our data processing (e.g. to a collection office or to IT service providers), we subject the contract data processor(s) to a contractual obligation only to use personal data in accordance with the requirements set out in the applicable data protection legislation and to ensure that the rights of the data subject are protected. Within this context, we also use IT services provided by our parent company, CTS EVENTIM AG & Co. KGaA, Munich, Germany. We also use IT service providers from the US that we conclude corresponding agreements with (in particular based on the standard contractual clauses of the European Commission), taking technical and organisational measures to ensure an appropriate level of security.
We are also authorised to pass personal data on to our parent companies CTS EVENTIM AG & Co. KGaA, Munich, Germany and Ringier Ltd, Zofingen for internal group reporting and analysis purposes.
